End User License Agreement

1. Parties and acceptance
This End User License Agreement (“EULA”) is between you — either an individual user, or the government agency, company, or other organization on whose behalf you are acting (“you” or “Licensee”) — and ThinkBOLD Solutions, LLC, a Wyoming limited liability company doing business as Hey Cass AI (“ThinkBOLD Solutions,” “Licensor,” “we,” “us”).
By accessing or using the Service — the Hey Cass AI web application and installable Progressive Web App (PWA) at heycass.ai — you agree to be bound by this EULA. If you do not agree, do not access or use the Service.
This EULA supplements, and does not replace, the Terms of Service. Where this EULA is silent, the Terms govern. See Section 10 (Incorporation and order of precedence).
2. The Application
Hey Cass AI (“Cass”) is a command-center application for Public Information Officers (PIOs), Joint Information Center personnel, emergency communicators, and the agencies and organizations that employ them. Cass helps you draft, organize, schedule, and send public communications — including press releases, hold statements, social content, and news alerts to your own media lists.
Nothing sends unreviewed. Cass drafts and prepares communications, but every send requires your explicit review and approval before it goes out. This is a design commitment, not just a feature — see Terms of Service §5 and the Acceptable Use Policy for the full framework governing AI-assisted messaging.
Cass is delivered as a hosted web application and an installable Progressive Web App (PWA). There is no app-store distribution of Hey Cass AI; this EULA does not involve, and no term of this EULA should be read as involving, Apple, Google, or any app-store operator as a party.
3. License grant
Subject to your compliance with this EULA, the Terms of Service, and the Acceptable Use Policy, ThinkBOLD Solutions grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Service — the hosted Hey Cass AI web application — for your own internal professional or governmental public-information work; and
- Install and use the Hey Cass AI installable PWA build on devices you own or control, solely as a means of accessing the Service.
ThinkBOLD Solutions reserves all rights not expressly granted here.
4. Restrictions
You may not:
- Share, sublicense, sell, rent, lease, or otherwise make the Service or the PWA available to any third party outside your organization, except to the extent your organization's active subscription expressly permits multi-seat internal use;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying AI models, or trade secrets of the Service, except to the extent applicable law prohibits this restriction;
- Copy, modify, or create derivative works of the Service or the PWA build, except as necessary to install and use it as permitted in Section 3;
- Remove or obscure any proprietary or intellectual-property notices appearing in the Service or the PWA build; or
- Use the Service in any manner that violates the Terms of Service or the Acceptable Use Policy.
Violating this section may result in suspension or termination of your access under Terms of Service §14, and may expose you to liability for damages.
5. Updates
ThinkBOLD Solutions may update, patch, or modify the Service and the PWA build from time to time, including to add features, apply security fixes, or respond to changes in underlying AI model providers. This license governs any such update unless a separate license is provided with it. We try to keep the Service current, but you are not guaranteed any specific update, feature, or release timeline. Material changes to this EULA follow the notice process in Terms of Service §18.
6. Support
ThinkBOLD Solutions provides commercially reasonable support by email at cass@heycass.ai, with a business-day response-time target. Support includes ongoing product updates and security patches at no additional charge during your license term. This is not a numeric service-level agreement (SLA); a formal SLA may be available on request once the Service reaches general availability. 7. Scope and certifications — what Hey Cass AI is and isn't built for
Hey Cass AI is not currently certified or accredited under HIPAA, FISMA, FedRAMP, StateRAMP, or any comparable government security-authorization framework, and we make no representation of such certification. The Service is not intended for the storage or processing of Protected Health Information (PHI), classified information, or other information subject to the frameworks listed above — see Acceptable Use Policy §3.
This does not disqualify government customers generally. Hey Cass AI is built for public-information work by government agencies and other organizations subject to public-records (FOIA and state-equivalent) obligations, and our data-handling and retention practices (see Privacy Policy) are designed with those obligations in mind. The limitation above is specific to PHI, classified information, and comparable regulated data categories — not a bar on government use of the Service.
8. Data
Your use of the Service is governed by the Privacy Policy, which describes what data we collect, how we use it, and the sub-processors that help operate the Service (see our sub-processor list). Government customers should also review Clauses 6 and 7 of the Government Entity Addendum, which address public-records cooperation and data export/ownership on termination and supersede general Terms provisions on those points for government customers.
9. Term and termination
This license begins when you first access or use the Service and continues until terminated. It terminates automatically if you violate this EULA, the Terms of Service, or the Acceptable Use Policy, or if the subscription or account through which you access the Service ends.
Termination is otherwise governed by Terms of Service §14 (notice, effect, and survival). On termination, you must stop using the Service and may uninstall the PWA build from your devices. Sections of this EULA that by their nature should survive termination — including Section 4 (Restrictions) as to materials already accessed, and Section 10 (Incorporation and order of precedence) — survive.
10. Incorporation and order of precedence
This EULA incorporates by reference the Terms of Service, Privacy Policy, Acceptable Use Policy, and Cookie Policy. This EULA does not restate or modify the disclaimers, limitation of liability, indemnification, or dispute-resolution terms in the Terms of Service — those provisions govern as written there.
Order of precedence, highest to lowest:
- An executed, signed Government Entity Addendum, if any (government customers only);
- The published Government Entity Addendum (government customers only — see Section 11);
- This EULA;
- The Terms of Service;
- Any other referenced policy (Privacy Policy, Acceptable Use Policy, Cookie Policy).
11. Government customers
If you are using the Service as, or on behalf of, a government entity, the Government Entity Addendum applies automatically and overrides the governing-law, arbitration, indemnification, liability-cap, and related provisions of this EULA and the Terms as described in that Addendum. A signable copy is available for procurement processes that require an executed document.
12. Governing law
This EULA is governed by the laws of the State of Wyoming, USA, consistent with Terms of Service §17, without regard to conflict-of-laws principles. If you are a government customer, the Government Entity Addendum governs law and venue in place of this section.
