Terms of Service

These Terms of Service (“Terms”) govern your use of Hey Cass AI(“Cass,” “we,” “us”), a product of ThinkBOLD Solutions, LLC, including the website at heycass.ai, the waitlist, future chatbot product, and any related services (collectively, the “Service”).
By using the Service or joining the waitlist, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Cookie Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you are using the Service for lawful, professional purposes.
2. What Hey Cass AI is
Hey Cass AI is an artificial intelligence assistant for Public Information Officers (PIOs), Joint Information Center personnel, emergency communicators, and the agencies and organizations that employ them. Cass is trained on publicly available emergency management doctrine (including FEMA, NIMS/ICS, NAGC, IAEM, and published After Action Reports) and provides:
- Study partnership for PIO certifications (L-0105, E-0388, Master PIO Program, EPIOP)
- Scenario rehearsal and message-map drafting
- Press release, hold statement, and social-content draft assistance
- After Action Report review and pattern recognition
3. AI nature of the Service — critical disclosure
Cass is an artificial intelligence character generated by software, not a human and not a credentialed PIO. Cass's responses are produced by large language model technology and may be incorrect, incomplete, out of date, or misleading.
You are solely responsible for verifying any output before using it for any public communication, regulatory filing, agency briefing, or operational decision.
4. Scope limits — what Cass is NOT for
These limits are not optional. Misuse of Cass in any of the following contexts is a violation of these Terms and our Acceptable Use Policy and may result in immediate suspension or termination of access:
- Live operational incident command. Cass must not be used to make real-time decisions during an active incident, mass casualty event, public health emergency, or other live operational context.
- Substitute for a credentialed PIO. Cass does not replace the judgment, authority, or credentials of a human Public Information Officer.
- Source of breaking news or real-time public alerts. Cass is not an emergency notification system. Use established public warning systems (IPAWS, WEA, and similar) for real public alerts.
- Source of legal, medical, financial, or licensed engineering advice.
- Partisan political content, vendor endorsements, or activities that compromise an active law-enforcement investigation or operation.
5. AI-generated messaging, email, and voice calls
Hey Cass AI may send or facilitate communications on behalf of you or Hey Cass AI itself by email, SMS/MMS, and (in the future) voice or chat. Some or all of these communications may be generated, drafted, or delivered by artificial intelligence. Use of these features is subject to the following terms, which we designed to keep us — and you — on the right side of the U.S. Telephone Consumer Protection Act (TCPA), the FCC's February 2024 ruling that AI-generated voice calls are “artificial voice” under the TCPA, the CAN-SPAM Act, state AI-disclosure laws (California AB 1018, Utah's AI Disclosure Act, and others), and carrier A2P 10DLC rules.
5.1 Outbound communications from Hey Cass AI to you
- Email: By joining the waitlist, you consent to receive transactional and product communications from cass@heycass.ai. AI-drafted messages will be sent from identifiable Hey Cass AI senders. Each marketing email includes a one-click unsubscribe link.
- SMS/MMS (when active): We will only send SMS to phone numbers that have provided prior express written consent via a check-the-box opt-in (with clear disclosure of message frequency, charges, and how to opt out). Every initial message identifies Hey Cass AI as the sender and includes HELP and STOP instructions. Reply STOP to opt out at any time; reply HELP for support.
- AI voice or chat (when active): Where we ever place outbound calls or run AI voice or chat interactions, the agent will identify itself as artificial intelligence at the start of the interaction, and outbound AI voice calls will only be made to recipients who have provided prior express written consent for AI / prerecorded calls. You can opt out of calls at any time.
5.2 Inbound interactions with Cass
When you message Cass or any Hey Cass AI channel — email, chat, SMS, or voice — you may be interacting with artificial intelligence. Cass and any related AI agents will disclose their AI nature at the start of the interaction. Conversations may be logged for service operation, safety, abuse prevention, and continuous improvement, as described in our Privacy Policy.
5.3 Your use of Cass to communicate with third parties
If you use Cass to draft, send, or place messages or calls to third parties, you are the sender for all legal purposes and are responsible for:
- Obtaining all required consents from recipients (TCPA, state telemarketing laws, GDPR, CASL, and any other applicable law) before sending SMS, placing calls, or sending automated emails.
- Honoring opt-out / do-not-call / unsubscribe requests promptly (within 10 business days at a minimum; sooner where law requires).
- Disclosing AI involvement to recipients where law or your agency's policy requires.
- Maintaining records of consent and opt-outs sufficient to demonstrate compliance.
You may not use Cass to generate or send unsolicited bulk communications, spoofed sender identities, robocalls without consent, impersonations of real officials, or any other communication that violates TCPA, CAN-SPAM, A2P 10DLC carrier rules, or analogous law in the recipient's jurisdiction. Violations of this section are violations of these Terms and our Acceptable Use Policy.
6. AI outputs — accuracy, verification, and your obligations
Cass produces text using large language model technology. Even with careful design, AI outputs carry well-known risks. By using the Service, you acknowledge and accept the following:
6.1 Outputs may be wrong
Cass can produce content that is factually incorrect, fabricated (“hallucinated”), outdated, internally inconsistent, or contradicted by source material — even when delivered with confidence. Cass may misquote doctrine, invent course numbers, attribute statements incorrectly, or describe events that did not happen.
We make no warranty of factual accuracy. You may not rely on Cass's outputs as authoritative without independent verification.
6.2 Bias and representational harm
Cass's outputs reflect patterns and biases present in her training data and underlying models. We work to limit harmful bias but cannot guarantee that any individual output is free of bias, stereotype, or representational gap. Treat Cass's outputs as a starting point, not as a neutral or definitive view.
6.3 Verification is your responsibility
Before using a Cass output for any consequential purpose — public statements, agency briefings, official press releases, regulatory filings, training materials, or any communication where accuracy matters — you must:
- Independently verify every factual claim against authoritative sources
- Review for unintended bias, omissions, or insensitive language
- Confirm alignment with your agency's policies and standards
- Have a credentialed human review high-stakes outputs before release
6.4 Disclose AI involvement when sharing outputs
When you publish, distribute, or share content that was substantially generated or drafted by Cass, you agree to disclose AI involvement as required by law, professional ethics, or your agency's policy. Examples include applicable journalism standards, government AI-disclosure laws (California AB 1018, Utah's AI Disclosure Act, and similar), academic policies, and accreditation rules. At minimum, do not represent AI-generated work as the work of a credentialed human without disclosure.
6.5 No professional advice
Cass's outputs are not professional advice — not legal, medical, financial, engineering, mental health, regulatory, or operational advice. Information provided by Cass does not create any professional, fiduciary, or agency relationship between you and Hey Cass AI.
6.6 No guarantee of similar outputs
Cass is non-deterministic; the same prompt may produce different outputs on different runs. We do not warrant that any specific prior output can be reproduced.
6.7 Ownership of outputs and third-party rights
Subject to your compliance with these Terms and our Acceptable Use Policy, you own the outputs you generate using Cass. You are responsible for ensuring that your use of those outputs does not infringe any third-party right — including copyright, trademark, publicity, privacy, or contractual rights. We make no representation that any specific output is original, public domain, or clear of third-party claims.
6.8 Safety filtering is best-effort
We apply safety controls to reduce the chance Cass produces harmful outputs. Those controls are best-effort, not infallible. Encountering an output that violates our Acceptable Use Policy is a reporting opportunity — please email cass@heycass.ai.
7. Accounts and access
Today, the Service is in private beta. Joining the waitlist does not guarantee access. When access is granted, you will receive a separate notification with onboarding instructions. We may grant, deny, or revoke access at our sole discretion, especially for violations of these Terms.
8. Your content
Any content you submit to Cass (queries, drafts, scenarios, agency details, etc.) remains your content. You grant ThinkBOLD Solutions, LLC a non-exclusive, worldwide, royalty-free license to use that content as necessary to operate and improve the Service, including processing through our AI model providers.
We may use anonymized, aggregated usage data to improve the Service and to publish broad insights about PIO topics and trends. We will not publish anything that personally identifies you or your agency without your written consent.
9. Intellectual property
The Service, including the Cass brand, illustration, voice, copy, software, and underlying systems, is owned by ThinkBOLD Solutions, LLC and protected by intellectual property law. You are granted a limited, revocable, non-transferable license to use the Service strictly for the purposes described in these Terms.
Cass's training material draws from publicly available emergency management doctrine; that material remains the intellectual property of its original authors and rights holders.
10. Service providers and sub-processors
We use third-party service providers to operate the Service, including for email delivery, customer relationship management, hosting, AI model inference, and payment processing. See our Sub-processor list for the current named providers and our Privacy Policy for how data flows through them.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE, COMPLETE, OR FIT FOR ANY PARTICULAR PURPOSE. Public information work is high-stakes; rely on your training, your agency's policies, and credentialed humans — not on Cass — for any consequential decision.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THINKBOLD SOLUTIONS, LLC AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY DECISIONS MADE BASED ON CASS'S OUTPUTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
13. Indemnification
You agree to indemnify, defend, and hold harmless ThinkBOLD Solutions, LLC and its officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms or our Acceptable Use Policy, (c) your violation of any third-party right, or (d) any content you submit to the Service.
14. Termination
We may suspend or terminate your access at any time, with or without notice, including for violations of these Terms. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
15. Dispute resolution — informal negotiation
Before filing any formal claim, you and Hey Cass AI agree to attempt to resolve the dispute informally by sending a written notice describing the issue to cass@heycass.ai. The parties agree to negotiate in good faith for at least 30 days before initiating any formal proceeding.
16. Binding arbitration and class-action waiver
If the dispute is not resolved through informal negotiation, you and Hey Cass AI agree to resolve any claim arising out of or relating to these Terms or the Service through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be held in Cheyenne, Wyoming or, at your election, conducted by video conference. Judgment on the award may be entered in any court of competent jurisdiction.
YOU AND HEY CASS AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If a court of competent jurisdiction finds this class-action waiver unenforceable as to a particular claim, then that claim (and only that claim) shall be severed from the arbitration agreement and proceed in a court of competent jurisdiction in Wyoming.
You may opt out of this arbitration agreement by sending a written opt-out notice to cass@heycass.ai within 30 days of first agreeing to these Terms.
17. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Subject to the arbitration agreement above, any dispute arising out of or relating to these Terms or the Service that proceeds in court will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.
18. Changes to these Terms
We may update these Terms from time to time. We will notify waitlist members and active users of material changes by email and post the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
19. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Hey Cass AI regarding the Service.
20. Data Processing Agreement (DPA)
Customers who require a Data Processing Agreement for GDPR, CCPA, or other privacy regulation compliance may request one by emailing cass@heycass.ai.
